These Terms & Conditions (“Terms”) govern your access to and use of the ELSOAR website, platform, and related services (collectively, the “Services”).

1. About ELSOAR

ELSOAR is an online platform designed to connect clients with licensed therapists in their local area.

ELSOAR is not a medical or healthcare provider, and our platform does not offer crisis intervention or emergency services. Therapists on our platform are independent professionals, not employees or agents of ELSOAR.

Our role is to facilitate the connection between you and a qualified therapist.

2. Eligibility

To use ELSOAR, you must:

  • Be at least 18 years of age (or the age of majority in your jurisdiction).
  • Have the legal capacity to enter into a binding agreement.
  • Provide accurate and complete information during registration.

If you do not meet these requirements, you may not use our Services.

3. Your Account

You are responsible for maintaining the confidentiality of your account login information.

You agree to:

  • Use your account for personal use only.
  • Notify us immediately of any unauthorized access or suspected breach.
  • Not share your login credentials with others.

ELSOAR is not liable for any loss or damage resulting from unauthorized use of your account.

4. Therapist Relationship

When you are matched with a therapist through ELSOAR:

  • You are entering into a direct client-therapist relationship with that professional.
  • Therapists are solely responsible for the quality, accuracy, and legality of the services they provide.
  • ELSOAR does not supervise, control, or guarantee the professional conduct or outcomes of therapy sessions.

All therapists on ELSOAR are independently licensed and required to comply with professional standards and regulations in their jurisdiction.

5. Payments and Fees

If you choose to engage with a therapist through ELSOAR:

  • Fees for therapy sessions are disclosed before booking.
  • Payments are processed securely through our third-party payment provider.
  • All fees are in the currency of your location (CAD or USD) unless otherwise stated.

Refunds, rescheduling, or cancellations are subject to each therapist’s individual policy.

6. Prohibited Use

You agree not to use the ELSOAR platform to:

  • Violate any law or regulation.
  • Post or share harmful, defamatory, or discriminatory content.
  • Impersonate another person or misrepresent your identity.
  • Interfere with or disrupt the security or operation of the platform.

7. Disclaimers

  • ELSOAR provides its platform and services “as is” and “as available.”
  • We make no guarantees about the results of therapy or the suitability of a particular therapist.
  • ELSOAR does not provide medical diagnosis, treatment, or prescriptions.

If you are in crisis or need emergency assistance, please call 911 or your local emergency number immediately.

8. Limitation of Liability

To the fullest extent permitted by law:

  • ELSOAR and its affiliates are not liable for any indirect, incidental, special, or consequential damages arising out of your use of our platform or services.
  • Our total liability for any claim related to your use of the platform shall not exceed the amount you paid (if any) for services within the last 12 months.

9. Indemnification

You agree to indemnify and hold harmless ELSOAR, its affiliates, officers, employees, and partners from any claims, losses, or damages resulting from:

  • Your use of the Services.
  • Your violation of these Terms or any law.
  • Any dispute between you and a therapist.

10. Intellectual Property

All content on the ELSOAR website — including text, graphics, logos, and software — is the property of ELSOAR or its licensors.

You may not copy, reproduce, or distribute any material without our written consent.

11. Termination

ELSOAR may suspend or terminate your account at any time if:

  • You violate these Terms.
  • You misuse or abuse the platform.
  • Required by law or requested by a therapist for safety or ethical reasons.

You may also deactivate your account at any time by contacting our support team.

12. Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada, and applicable federal laws.

For users in the United States, local state laws may also apply.

Any disputes shall be resolved through good-faith negotiation or binding arbitration as permitted by law.

13. Modifications to Terms

We may update these Terms from time to time. Any changes will be posted on this page with an updated “Effective Date.”

Your continued use of the platform after such changes constitutes acceptance of the new Terms.
